The following license applies to all applications of the company END USER LICENSE AGREEMENT FOR NOON INFORMATICS SA’s SOFTWARE.
IMPORTANT-READ CAREFULLY:
This End User License Agreement of NOON INFORMATICS SA (“License”) is a legal agreement between you (either a natural or legal person) and NOON INFORMATICS SA aiming at any software product of NOON INFORMATICS SA, which includes computer software and may include associated storage devices, printed material and direct (“online”) or electronic documentation (“SOFTWARE PRODUCT”). Any software provided with the SOFTWARE PRODUCT that has a separate end user license, is granted under the terms of this license. By installing, copying, downloading, accessing or using in any way the SOFTWARE PRODUCT, you declare your agreement to the terms of this License and you are bound by it. If you do not agree with the terms of this License, do not install or use the SOFTWARE PRODUCT. You may, however, return it to the point of sale, for a full refund.
SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by the laws and international policies of copyright in addition with other relevant laws and agreements. Only the license of the SOFTWARE PRODUCT is granted. The SOFTWARE PRODUCT is not sold.
1. GRANT OF LICENSE
With this license you are granted the following privileges:
Application Software. You may install, use, access, display, run or use otherwise (“RUN”) a copy of the SOFTWARE PRODUCT or any of its previous versions on the same operating system, on only one personal computer, workstation.
Additional licenses. You may install and use the Software Product on more than one computer only if you have purchased a separate license of SOFTWARE PRODUCT for each computer by NOON INFORMATICS SA or by an authorized partner (reseller).
Storage / Network Use. You are also allowed to store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a proxy server, which will be used only for the implementation of the SOFTWARE PRODUCT on other COMPUTERS through an internal network. However, you must obtain and dedicate a License for all the COMPUTERS running the SOFTWARE PRODUCT from the storage device. One license for the SOFTWARE PRODUCT cannot be shared or used concurrently on different COMPUTERS.
All rights reserved. NOON INFORMATICS SA reserves all rights not expressly granted.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
– Software not for resale. You may not resale or generally transfer the SOFTWARE PRODUCT, regardless of what is referred to other sections of this License. Partners (resellers) of the company are excluded after a special written agreement.
– Restrictions on Reverse Engineering and on Decompilation and Disassembly. You may not proceed to reverse engineering, decompilation or disassembly of the SOFTWARE PRODUCT, except for the only case that such activities are explicitly permitted by the current law notwithstanding the above limitation.
– Separation of components. The License refers to the SOFTWARE PRODUCT as a single product. You may not separate components for use on more than one COMPUTER.
– Trademarks. This License does not grant you any rights in respect of any brands of products or services of NOON INFORMATICS SA.
– Leasing, rental or lending of the SOFTWARE PRODUCT is not allowed.
– Support Services. NOON INFORMATICS SA may provide support services regarding the SOFTWARE PRODUCT (“Support Services”). Use of Support Services is subject to the policy and the established programs of NOON INFORMATICS SA as described in the manual, in the direct (“online”) documentation and / or other materials provided by NOON INFORMATICS SA. Any supplementary software code provided to you under the Support Services shall be considered part of the SOFTWARE PRODUCT and will be subject to the terms and conditions of this License. As far as the technical information you provide to NOON INFORMATICS SA for technical support is concerned, NOON SA INFORMATICS has the right to use it for business purposes, which include support and product development. NOON INFORMATICS SA will not use such technical information in a way that discloses your identity.
3. UPGRADES
If the SOFTWARE PRODUCT labels an upgraded version, you should have the necessary permission of the product that is identified by NOON INFORMATICS SA as a product suitable for upgrade, in order to be entitled to use it. A software product that is labeled “Upgrade” replaces and / or supplements (and may disable) the product that formed the basis of your rights for the use of this upgrade. You may use the resulting upgraded product only in accordance with the terms of this License. If the SOFTWARE PRODUCT is an upgraded component of a software package for which you are granted a license as a single product, the SOFTWARE PRODUCT may be used and transferred only as part of that single product package and may not be separated for use on more than one COMPUTER.
4. COPYRIGHT
All title rights contained in the SOFTWARE PRODUCT (including, for instance, images, photographs, animation, video, sounds, music, text and applets that are embedded in SOFTWARE PRODUCT), in the literature accompanying it or in any copies of the SOFTWARE PRODUCT, as well as the copyright relating to the above, are owned by NOON INFORMATICS SA or its suppliers. All title rights and copyright contained in the content which is accessible through the use of the SOFTWARE PRODUCT are owned by the respective content owner and may be protected by current laws and copyrights or other laws and conventions on copyright protection. This License does not grant you any privilege to use this content. If this SOFTWARE PRODUCT contains documentation that is provided only in electronic form, you may print a copy of this electronic documentation. You have no right to reproduce the printed materials accompanying the SOFTWARE PRODUCT.
5. SOFTWARE TO TWO STORAGE MEDIA
You may receive the SOFTWARE PRODUCT in more than one storage media. Regardless of the type or size of the storage device you will receive, you may use only one storage medium that is appropriate for your specific COMPUTER. You are not allowed to run the software from the other storage medium to another computer. You may not lend to lease, rent or otherwise transfer the other storage medium to another user with the exception of a part of permanent transfer (as defined above) of the SOFTWARE PRODUCT.
6. SECURITY BACKUP
After installing a copy of the SOFTWARE PRODUCT pursuant to this License, you can keep the original storage medium in which you were given the SOFTWARE PRODUCT by NOON INFORMATICS SA only for the purpose of keeping a security backup or archive. If the original storage medium is required in order to use the SOFTWARE PRODUCT on the COMPUTER, you have the right to make a copy of the SOFTWARE PRODUCT solely for backup or archival purposes. With the exception of the explicit provisions of this License, you may not otherwise create copies of the SOFTWARE PRODUCT or the printed materials accompanying the SOFTWARE PRODUCT.
7. SCOPE OF RESPONSIBILITY
NOON INFORMATICS SA, although it has checked the compliance and quality of the program, does not provide any guarantee of compliance and errors of the SOFTWARE PRODUCT and is not responsible in any way towards the customer for any direct or indirect loss or damage caused or connected with the use or inability of use of the Software Product. NOON INFORMATICS SA does not guarantee either the completeness of the information contained in the program or their absolute accuracy. The customer, acknowledging the possibility of an error or omission, must cross-check and verify the obtained information to original sources. (Any possible responsibility of the manufacturer and its delegates is limited to the value of the Software Product).
JURISDICTIONS FOR THE HEARING OF ANY DISPUTE CONCERNING THE INTERPRETATION AND IMPLEMENTATION OF THIS AGREEMENT ARE THE COURTS OF ATHENS.
Services Terms Of Use
Hosting – Domain
1.1. New ordering and renewal
The Customer has the ability to place an order for the Web Hosting package he wants by choosing one of the standard packages offered by NOON INFORMATICS SA or by adapting one to his needs. The customer must settle the financial settlement of his new order within 30 calendar days of the invoicing day. If the order is not paid after 30 calendar days, hosting is completely deleted from the computer server of NOON INFORMATICS SA without further notice and without backing up.
In order to renew an existing and active Web Hosting service, the Customer is required to pay the relevant cost until the subscription expiry date. Beyond that date, and provided there is no other notification from Customer to NOON INFORMATICS SA Technology for renewal of the service, within 30 calendar days of the service termination date, hosting is completely deleted from the server of the company. The re-activation of the service is at the written request of the customer and costing the company.
The above mentioned actions are performed automatically by the company’s system without additional notice for deactivation and deletion.
1.2. Customers Information
The Customer is informed of its financial pending issues and of the expiration date of each service via e-mails sent to the e-mail address registered in NOON INFORMATICS SA Technology. Additionally, NOON INFORMATICS SA informs about the existence of a Hosting / Domain-related financial pending due to the activation of a new subscription or expiration of an existing one as well as for its settlement.
The Customer must notify the Company of any change to his or her account data to be valid and active. NOON INFORMATICS SA is not responsible for failing to inform the Customer (electronic and / or telephone communication, which is, however, optional) due to invalid contact details and, consequently, to deactivate its services, provided the financial outstanding remains.
1.3. Customers Obligations
The Customer must pay in due time and within the time specified the amount required to settle its outstanding financials. With the settlement of financial pending issues, the renewal of Web Hosting and Domain name is automatically performed. NOON INFORMATICS SA has no responsibility to deactivate the Customer’s services due to invalid payment of the corresponding amount, provided it has not been notified by the Customer.
1.4. Issuing a deposit slip
The corresponding documents are issued after the cost of the corresponding service and are sent by NOON INFORMATICS SA to the customer. The Customer has to inform NOON INFORMATICS SA about the type of document (proof, invoice) he wishes to receive for his / her deposit and the data to be issued. In the case of an invoice, the following information is required: Full name, Address, VAT number, VAT number and Occupation. Receipts and invoices are sent to the address registered in NOON INFORMATICS SA Technology under Customer’s username but may also be sent to a secondary address if the Customer informs the company.
1.5. Payment and Billing policy
The charges for the services provided by NOON INFORMATICS SA are made on the basis of the price list for which the company retains the right to readjust.
No reimbursement is provided for any Domain name, Domain name, renewal service that is activated for the customer, in the event the customer changes service provider before termination of the service.
Acceptance of Terms of Service (applies to all services)
The reading of this text is required prior to the use of NOON INFORMATICS SA IT services. Making an order for some of the services provided by the company means understanding and accepting the above mentioned terms of use of web hosting / domain name renewal services. If a customer does not agree with these terms, please do not use the services provided by NOON INFORMATICS SA. NOON INFORMATICS SA has no liability in the event of a potential future dispute between the Customer and the terms of use.
